I am creating a new business and brainstormed the perfect name. Research on Google shows but one business in the same industry who operates five States away.Immediately I looked up the trademark database (USPTO) and dug through all relevant filings, but none are filed for this name in this industry.Question: Am I safe to file this business name with my State? On an ethical level, is it better to leave the name alone? It is a perfect fit for the business I am creating.And, lastly, I ask of you who are wise in business: Is it worth my energy to claim a name that may bring me future problems?
